These Terms & Conditions govern the contractual relationship between De la Tierra Travels (hereinafter “the Organiser”) and the customer who purchases a package tour. The agreement is entered into and performed in accordance with the Swedish Package Travel Act (Paketreselagen 2018:1218) and applicable EU regulations.
By booking a journey with De la Tierra Travels, you confirm that you have read, understood, and accepted these Terms & Conditions.
The contract consists of the following parts:

These Terms & Conditions
In the event of any discrepancy between documents, the information on the invoice/travel confirmation shall prevail.
1. Entering into the Agreement
1.1 Formation of Contract
A binding agreement between the customer and the Organiser is formed when:

The customer has accepted the offer, and
-
The customer has paid the full amount due at the time of booking.
The customer is responsible for ensuring that all information provided is accurate and complete.
1.2 Travel Documents
The Organiser will send an invoice/travel confirmation and a link to the programme description to the customer upon booking. All correspondence will be sent to the email address provided by the customer at the time of booking.
The customer is responsible for:

Providing accurate contact information for use before and during the journey.

Reviewing the invoice/travel confirmation upon receipt and immediately notifying the Organiser of any discrepancies.
1.2.1 Invoice/Travel Confirmation
The invoice/travel confirmation serves as an overview of the booking, including:

Full names of all travellers
-
Any additional purchases
-
Payment information
-
Travel itinerary with current times
-
Any deviations from the programme
The invoice/travel confirmation is also the customer’s receipt for booking and payment. We recommend printing or saving a digital copy.
1.2.2 Journey Programme
The journey programme contains a description of the journey, current prices, expected additional costs, practical information, and any special conditions applicable to the specific journey. This information is intended as a service to our customers but also contains formal information.
2. Price
2.1 Total Price
The price of the journey is a total price, which includes all mandatory taxes and fees. However, some local taxes, fees, and entrance charges may not be payable in advance and must be paid on-site. These will normally be stated in the travel documents or journey programme.
Please note that such fees may change between the time of booking and departure.
2.2 Payment Terms

Full payment of the total package price is required at the time of booking to secure your reservation.

We accept the following payment methods:
-
Bank transfer (IBAN provided on invoice)
-
Credit/debit card (via Stripe or PayPal – a 2.5% surcharge applies)
-
Invoice for corporate clients (payment terms: 14 days net)
-
If payment is not received by the due date, the Organiser reserves the right to cancel the agreement and retain any amounts due according to the cancellation rules in Section 6.2.1.
3. Travel Insurance
All participants on De la Tierra Travels journeys are strongly recommended to have travel insurance that covers, at minimum:

Medical expenses and emergency repatriation
-
Trip cancellation and interruption
-
Loss or theft of luggage and personal belongings
-
Force Majeure events (e.g., pandemics, natural disasters)
Travel insurance is not included in the package price. The customer is responsible for ensuring adequate coverage before departure.
4. Customer’s General Obligations
4.1 Passport and Visa
Unless otherwise stated, visa information applies to Swedish citizens and is related to the specified itinerary. Customers with other nationalities must consult their embassy or consulate regarding visa requirements.

Passports must be valid for at least 6 months beyond the return date.

The customer is responsible for ensuring they have a valid passport and any necessary visas.
-
The Organiser assumes no responsibility for consequences arising from missing travel documents, vaccinations, or other requirements.
4.2 Vaccination Requirements
The Organiser provides information on vaccination requirements but not necessarily on recommended prophylactic measures, which should be obtained from your doctor. Any information provided by the Organiser is a service and does not imply liability.
4.3 Physical Ability Requirements
As a general rule, participants must be able to manage independently. Our journeys are not adapted for persons with highly reduced mobility.
The Organiser reserves the right to refuse participants who, in the Organiser’s assessment, cannot complete the journey independently.
4.4 Review of Travel Documents
The customer is responsible for reviewing all travel documents and practical information and immediately notifying the Organiser of any discrepancies. The customer must also inform the Organiser of any changes in their circumstances after booking (e.g., illness, pregnancy).
4.5 Name on Travel Documents
It is the customer’s responsibility to ensure that names on travel documents match the full name in their passport. Discrepancies may result in visa rejection. If the error is due to the customer, any costs incurred will be borne by the customer.
4.6 Air Travel
Flight tickets are booked for a specific journey and cannot be changed, cancelled, extended, or transferred without restrictions. Change and cancellation fees vary by ticket type and may in some cases amount to the full ticket price.

Times stated are local times.

Changes may occur if the itinerary was prepared long before departure. The customer should check departure times on their tickets.
-
Check-in is normally two hours before departure. The customer is responsible for being aware of current airport, security, and regulatory conditions.
4.7 Code of Conduct
The customer must comply with the rules of conduct applicable to all suppliers (e.g., hotels, airports, transport). The customer must behave in a manner that does not disturb or offend other travellers.
In case of serious or repeated violations, the Organiser or its representatives may prevent the customer from continuing the journey. In such cases, the customer is responsible for their own return transport and associated costs, and is not entitled to compensation or refund.
The Organiser is not responsible for public authority actions, including police intervention, in response to inappropriate customer behaviour.
4.7.1 Violations
If the customer fails to comply with requirements regarding passport, visa, health, correct name on travel documents, or review of travel documents, the customer cannot hold the Organiser, travel agent, or supplier liable for any consequences, deficiencies, or losses arising from this.
5. Changes to the Agreement
5.1 Transfer of the Package Tour
Under certain circumstances, a customer may transfer their journey to a family member or friend for a fee. The fee depends on the nature of the journey.

The person taking over the package tour must meet all necessary conditions and requirements set by the Organiser, including passport, visa, and health requirements.
-
The possibility of transferring the package tour may be limited by supplier conditions.
5.2 Price Changes
The Organiser may change the agreed price after the agreement is entered into if there are changes in:

Transport prices due to fuel or energy costs
-
Taxes, fees, or other charges for package tour services imposed by third parties
The Organiser will notify the customer of price increases and decreases in writing at least 20 days before departure. The price may be increased by a maximum of 8% of the package tour price. If the increase exceeds 8%, the customer has the right to terminate the agreement.
In case of price reductions, the customer is entitled to a corresponding reduction, minus any costs incurred by the Organiser for refunding the customer.
5.3 Customer’s Right to Change the Package Tour
If the customer wishes to make changes to the package tour, they should contact the Organiser as soon as possible. If the Organiser can accommodate the changes, the customer must pay any additional costs incurred.
If the customer wishes to make changes that the Organiser cannot accommodate within the existing agreement, the change will be treated as a cancellation according to Section 6.2.1 and a new booking.
5.4 Organiser’s Right to Change the Package Tour
5.4.1 Non-Essential Changes
The Organiser has the right to make non-essential changes to the package tour without the customer’s consent before the journey begins. The customer is obliged to accept such changes if the Organiser informs the customer clearly and without undue delay before the journey begins.
For adventure-style journeys, late changes may be made to create the best possible experience considering weather and local conditions. On journeys to remote areas, changes due to weather and infrastructure may occur so frequently that the customer must regard them as a natural part of the journey. No compensation is given for delays or changes lasting less than 24 hours.
5.4.2 Other Changes
If the Organiser, before the journey begins:

Makes significant changes to the package tour,
-
Cannot deliver specific services the customer expects and the Organiser has agreed to deliver, or
-
Increases the price by more than 8%
The customer has the right to:
-
Terminate the agreement and receive a full refund of the amount paid, or
-
Participate in a replacement journey if offered by the Organiser.
The Organiser must inform the customer of significant changes without undue delay. The Organiser will set a reasonable deadline for the customer to inform of their decision. If the deadline is not met, the customer is deemed to have accepted the changes.
The customer may in certain situations be entitled to compensation for financial loss resulting from significant changes, unless the cause is unavoidable or extraordinary circumstances.
5.4.3 Flight Delays
For flight delays covered by EU Regulation 261/2004, the customer must submit claims directly to the airline, as this legislation governs the relationship between passenger and airline. The Organiser is not subject to Regulation 261 but is covered by the Package Travel Act.
The Organiser’s liability is limited to the restrictions set by international regulations and conventions. If the airline offers compensation on-site, no further claims for compensation can be made.
6. Termination of the Agreement
6.1 Right of Withdrawal
There is no right of withdrawal for the purchase of package tours.
6.2 Cancellation of Package Tours
6.2.1 General Cancellation Terms
Unless otherwise stated on the invoice, the following rules apply. Please note that extraordinary costs may apply to certain journeys.

6.2.2 Cancellation due to Force Majeure
The customer may cancel a package tour without charge before it begins if unavoidable and extraordinary circumstances occur at the destination or in its immediate vicinity that significantly affect the performance of the package tour or transport to the destination.
For the customer to cancel without charge, the circumstances must, based on an objective assessment, make it impossible to travel safely to the destination, for example based on information from the Ministry for Foreign Affairs, health authorities, or similar.
The customer then has the right to cancel without charge and to a full refund of the journey price but is not entitled to further compensation from the Organiser.
The free cancellation right does not apply if the customer knew or should have known of the circumstances, or if the circumstance was generally known, when the agreement was entered into.
If the customer cannot cancel free of charge according to the above, the general cancellation rules apply (Section 6.2.1).
6.2.3 Time of Refund and Calculation of Cancellation Fee
Refunds according to Sections 6.2.1 and 6.2.2 shall be made no later than 14 days after the customer’s cancellation of the package tour. The fee is calculated at this time, provided there is a possibility to resell the cancelled travel services.
6.3 Organiser’s Right to Cancel the Journey
6.3.1 Cancelled Journey due to Insufficient Participants
If the journey’s performance depends on a minimum number of participants, this will be stated in the Organiser’s offer or elsewhere in the agreement. The minimum number of participants and the deadline for achieving this number will also be stated.
If the required number of participants is not achieved by the specified deadline, the Organiser may terminate the agreement without liability. The Organiser will notify the customer of the termination before the deadline specified in the agreement, but no later than:

20 days before the package tour begins if the journey duration exceeds 6 days
-
7 days before the package tour begins if the journey duration is between 2 and 6 days
-
48 hours before the package tour begins if the journey duration is less than 2 days
6.3.2 Cancellation due to Unavoidable or Extraordinary Circumstances
The Organiser may also terminate the package tour agreement without liability if the Organiser is prevented from fulfilling the agreement due to unavoidable and extraordinary circumstances. The Organiser will notify the customer of the termination without undue delay and before the package tour begins.
The customer will receive a refund of the amount paid for the journey no later than 14 days after the agreement is terminated. The customer cannot claim compensation.
7. Deficiencies and Complaints
If a deficiency is discovered after the journey begins, during the journey, or at the destination, the customer must immediately report the deficiency to the Organiser, the Organiser’s representative at the destination, or the supplier concerned.
If the Organiser’s representative or supplier cannot or will not remedy the deficiency, or if the customer is not satisfied with the assistance received, the customer must complain directly to the Organiser by email at info@delatierratravels.com.
The customer must ensure that the complaint is noted by the Organiser’s staff and/or supplier on-site, for example, by a note in the hotel book or in another written form. The customer should also obtain a receipt for the complaint.
If the customer does not make the complaint described above, this may affect the customer’s right to subsequently invoke the deficiency and claim compensation.
8. Limitations of the Organiser’s Liability
Airlines are directly responsible for the correct performance of transport according to the Warsaw and Montreal Conventions, EU Regulations 889/2002 and 261/2004, and the Swedish Aviation Act.
The Organiser limits its liability to the applicable limits set out in the Warsaw and Montreal Conventions (air transport), the Athens Convention and EU Regulation 392/2009 (sea transport), and the COTIF Convention and EU Regulation 1371/2007 (rail transport). The Organiser’s liability cannot exceed the amount applicable to the carriers directly responsible for the transport.
If the carrier’s liability is not limited by other EU legislation or international conventions, the Organiser limits its liability to three times the total price of the package tour.
9. Claims After the Journey
Claims for compensation and/or corresponding deductions from the journey price due to deficiencies that have been correctly reported and not remedied by the Organiser must be submitted to the Organiser within a reasonable time after the journey ends. Otherwise, the customer loses the right to claim against the Organiser.
The customer may submit their complaint to info@delatierratravels.com no later than 3 months after returning from the journey.
10. Set-off When Paying Compensation
When the customer submits a complaint to the Organiser, the customer must inform whether they have also applied for compensation from the carrier under EU passenger rights legislation and international conventions.
If the customer has received compensation from the carrier, the Organiser has the right to deduct this compensation from any compensation the customer receives from the Organiser under the Package Travel Act.
11. Disputes
If the parties cannot agree, the dispute may be heard by the Swedish National Board for Consumer Disputes (Allmänna reklamationsnämnden, ARN), www.arn.se.
Complaints to ARN can also be submitted online via the European Consumer Centre’s dispute platform.
All disputes and irregularities that cannot be resolved between the parties separately or by ARN may, if the parties so wish, be heard by a court for a final decision and will be governed by Swedish law.
12. Guarantee in the Travel Guarantee Fund
In the event of insolvency, the Organiser has provided a guarantee for compensation of the customer’s payments to:
